3a. Broken, Damaged or Faulty Media

VHS to Digital is not liable for tapes or reels that are already broken, snapped, tangled, mouldy, sticky or otherwise damaged prior to or during normal playback. Where a customer requests that VHS to Digital attempt to repair a tape or reel before conversion, an additional repair and handling fee will apply. This fee will be communicated before work commences and must be agreed to in writing (including by text or email) before any repair is attempted. Repair attempts do not guarantee a successful conversion. VHS to Digital accepts no liability for further damage that may occur during a repair attempt on already compromised media.

4. Customer Warranties

By providing tapes, reels or other media, you confirm that:

  • You own the material or have permission from the lawful owner to request the transfer
  • The content is lawful and does not breach Australian law
  • The material does not contain illegal or prohibited content

VHS to Digital reserves the right to refuse, stop or report any job that appears unlawful or inappropriate.

5. Media Condition & Risk

Old tapes and film can be fragile, mouldy, sticky, brittle or otherwise degraded. Reasonable care is taken during handling and transfer, however some items may already be damaged or may fail during normal playback. VHS to Digital is not liable for pre-existing damage, deterioration or unsuccessful transfers caused by the condition of the original media.

VHS to Digital is not responsible for tapes or reels that break, snap or become unplayable during the conversion process where such failure is caused by the pre-existing condition of the media. Customers submit fragile or aged media at their own risk.

Where a tape or reel requires repair before conversion can be attempted, an additional fee will apply. This will be discussed and agreed with the customer before any repair work begins. Repair is not guaranteed to result in a successful conversion.

No charge applies for completely blank or fully unplayable tapes where no usable transfer can be produced.

6. Output Quality

Digitising preserves and makes your footage easier to access, but it does not guarantee a "restored" or high-definition result. The final quality depends largely on the original recording quality and the condition of the source media.

7. Privacy & Confidentiality

Personal and family recordings are handled discreetly. Files created during the transfer process are retained only as long as reasonably needed to complete the order and delivery, unless a longer period is requested or legally required.

8. Delivery, Collection & Storage

Customers are responsible for collecting their completed order unless another arrangement has been agreed. If postage, return delivery or other special handling is requested, additional charges and conditions may apply.

8a. Mail-In Service — Shipping Liability

For customers using the Melbourne or any other mail-in service, the following conditions apply:

  • Inbound shipping (customer to VHS to Digital): The customer is solely responsible for the safe packing and posting of their tapes and reels. VHS to Digital accepts no liability for items lost, delayed, or damaged by Australia Post or any other carrier while in transit to us. Customers are encouraged to use tracked postage and retain their tracking number.
  • Return shipping (VHS to Digital to customer): VHS to Digital will use tracked Australia Post Parcel Post for all return shipments. Once a parcel has been lodged with Australia Post and a tracking number issued, VHS to Digital accepts no liability for loss, delay or damage caused by Australia Post or any other carrier. Any claims for lost or damaged return parcels must be directed to Australia Post by the customer.
  • Return address: The customer is responsible for providing a correct and complete return address at the time of ordering. VHS to Digital accepts no liability for parcels delivered to an incorrect address provided by the customer.
  • Undeliverable parcels: If a return parcel is returned to VHS to Digital as undeliverable due to an incorrect or incomplete address provided by the customer, re-delivery will incur an additional postage charge payable by the customer before the parcel is resent.

9. Refunds

If VHS to Digital is unable to produce any usable transfer due to an issue entirely within its control, a refund may be offered. No refund is available once a successful transfer has been completed and delivered, except where required by Australian Consumer Law.

10. Limitation of Liability

To the maximum extent permitted by law, total liability for any claim related to the service is limited to the amount paid by the customer for the relevant order.

11. Governing Law

These terms are governed by the laws of South Australia.
